Please read these Terms of Use (the "Terms") carefully as they govern your use of (including access to) MonkeyMusic's personalized services for listening to music and other content, including all websites and software applications that incorporate the Terms or are linked to (collectively, the "MonkeyMusic Service") and all music, videos, podcasts or other material available on the MonkeyMusic Service (the "Content").

By registering with MonkeyMusic you agree, allow and authorize MonkeyMusic and Noel Mercedes CIO creator and founder of MonkeyMusic, to make audio transmissions, catalogs, music, podcasts and redistribute audio content within your MonkeyMusic application.

The MonkeyMusic application is a tool for you to publish your songs or audio and catalog publicly for the enjoyment of your music, audio, catalog or other content within the application.

The application allows users to listen and view audio and catalog content, posted, uploaded or published by the user or artist.

Use of the MonkeyMusic Service may be subject to other terms and conditions provided by MonkeyMusic, which are incorporated into these Terms by this reference.

By registering for or using the MonkeyMusic Service, you agree to the Terms. If you do not agree to the Terms, you must not use the MonkeyMusic Service or access any Content.

Service provider
The Terms are agreed between you and MonkeyMusic Team.

Age and eligibility requirements
To use the MonkeyMusic Service and access any Content, you must (1) be at least 13 years old (or the equivalent minimum age in your country), (2) have the consent of a parent or guardian if in your country you are considered a minor, (3) be able to enter into a binding contract with us without being prohibited by applicable law, and (4) reside in a country in which the Service is available. Furthermore, you promise that all registration information you provide to MonkeyMusic is true, accurate and complete, and you agree to keep it true. If you are a minor in your country, your parent or guardian must agree to these Terms on your behalf. You can find more information about age requirements in the registration process. If you do not meet the minimum age requirements, you cannot register as a user on MonkeyMusic.

The MonkeyMusic Service we provide

We provide you with various options on the MonkeyMusic Service. Some features of the MonkeyMusic Service are provided free of charge, while others require payment before access (the "Paid Subscriptions"). In addition, we may offer you promotional plans, memberships, or special services, including third-party products and services. We are not responsible for products and services provided by third parties.

Unlimited Service may not be available to all users. We will explain to you what services are available to you at the time you sign up for those services. If you cancel your subscription to the Unlimited Service, or if your subscription is interrupted (for example, if you change your payment details), you may not be able to re-subscribe to the Unlimited Service. Please note that Unlimited Service may be discontinued in the future; if this is the case, you will no longer be charged for the Service.

Tests
From time to time, we or others on our behalf may offer trials of Paid Subscriptions for a specified period of time for free or at a reduced rate (a "Trial"). By using a MonkeyMusic Service, you agree to the MonkeyMusic Premium Promotional Offer Terms.

Third-Party Open Source Software, Devices, and Applications
The MonkeyMusic Service may be integrated with third party applications, websites, and services ("Third Party Applications"), as well as personal computers, cell phones, tablets, handheld devices, speakers, and other third party devices ("Devices"). ) or interact with them. Use of Third Party Applications and Devices may be subject to additional terms, conditions and policies provided by the applicable third party. MonkeyMusic does not guarantee that Third Party Applications and Devices will be compatible with the MonkeyMusic Service.

Limitations and modifications of the Service
We make every reasonable effort to keep the MonkeyMusic Service up and running and to provide you with a personalized and immersive audio experience. However, our service offerings and their availability may change from time to time, subject to applicable law and without liability to you, for example:

The MonkeyMusic Services may experience temporary interruptions due to technical difficulties, maintenance, testing or updates, including those necessary to reflect changes in applicable laws and regulatory requirements.
Our goal is to constantly evolve and improve our Services, so we may modify the MonkeyMusic Service in whole or in part (including feature functions, subscription plans and promotional offers in particular), suspend or stop providing it ( temporarily or permanently).
MonkeyMusic is not obligated to provide any specific content

or through the MonkeyMusic Service and MonkeyMusic or other appropriate owners may remove particular songs, videos, podcasts and other Content without notice.
If you have previously paid fees directly to MonkeyMusic for any Paid Subscriptions that MonkeyMusic ceases to provide prior to your Prepaid Period (as that term is defined in the Payments and Cancellations section below), MonkeyMusic will refund the Prepaid Fees for the Prepaid Period for the Subscription. unused portion of your current Paid Subscription after it is no longer provided. Your account and billing information must be up-to-date in order for us to refund your fees.

MonkeyMusic has no liability to you, nor any obligation to provide you with a refund in connection with outages or failures of the internet or other services, caused by the actions of government authorities, other third parties, or events beyond our control.
