  1. About this Policy
This Policy describes how we process your personal data at MonkeyMusic.
It applies to the following uses:
• all MonkeyMusic streaming services as a user. For example, this includes the following:
◦ your use of MonkeyMusic on any device
◦ personalization of your user experience
◦ the mandatory infrastructure to provide our services
◦ connecting your MonkeyMusic account with another application
◦ our free and paid streaming options (each a "Service Option")
• other MonkeyMusic services that include a link to this Privacy Policy. These include the MonkeyMusic websites, customer support and community site.
From now on, we will collectively call them "MonkeyMusic Services".
From time to time, we may develop new services or offer additional services. Those services will also be subject to this Policy, unless otherwise stated when we introduce them.
This Policy is not...
• the same as the MonkeyMusic Terms of Use, which is a separate document. The Terms of Use describe the legal agreement between you and MonkeyMusic to use the MonkeyMusic Service. The rules of MonkeyMusic and your user rights are also described.
• about the use of other MonkeyMusic services that have their own privacy policy. Other MonkeyMusic services include Anchor, MonkeyMusic and the MonkeyMusic Live app.

The main information about your personal data is found here, in this Policy. However, you may want to read about other privacy resources and controls:

• Notification settings: set what advertising information you receive from MonkeyMusic.
• Settings (found on the desktop and mobile versions of MonkeyMusic) – Control certain aspects of the MonkeyMusic Service such as "Social" or "Explicit Content." In the "Social" configuration parameter, you can do the following:

In the "Explicit Content" settings, you can control the playback of explicit content in your MonkeyMusic account.

2. Rights and controls over your personal data
Privacy laws, including the General Data Protection Regulation ("GDPR"), give individuals rights over their personal data.
Some rights only apply when MonkeyMusic uses a certain "legal basis" to process your data. We explain each legal basis, and when MonkeyMusic uses each one, in section 4: The purpose of using your personal data MonkeyMusic.

Information
Be informed about the personal data we process about you and how we process it.

Access
Request access to the personal data we process about you.
To request a copy of your personal data from MonkeyMusic, you can:
• visit the Privacy Settings of your account. There, you can automatically download much of your personal data and find out how to request additional information.
• contact us to get all the information we have about you at once, without having to use the automatic download tool first.

When you download your data, you will receive the information about your data that MonkeyMusic has to provide under article 15 of the GDPR. If you want more information about how we process your personal data, you can contact us.
Rectification
Request that we change or update personal data that is inaccurate or incomplete.
You can edit your User Data in the Edit Profile section of your account or by contacting us.
Elimination
Request that we delete some of your personal data.
For example, you can ask us to delete the following personal data:
• those we no longer need for the purpose for which they were collected
• those we process based on the legal basis of consent, and withdraw your consent
• when you object (see the Object section below) and
◦ when you make a justified objection
◦ when you oppose direct advertising

There are situations where MonkeyMusic cannot delete your data; for example when:
• it is still necessary to process the data for the purpose for which we collected it.
• MonkeyMusic's interest in using the data prevails over your interest in deleting it. For example, when we need the data to protect our services against fraud.
• MonkeyMusic has a legal obligation to keep the data.
• MonkeyMusic needs the data to formulate, exercise or defend legal claims. For example, if there is an unresolved issue related to your account.
There are many ways to delete your personal data from MonkeyMusic:
• You can remove audio content from your profile by selecting the relevant content and deleting it. For example, you can remove playlists from your profile or remove a song from your playlist.
• To request deletion of your other personal data from MonkeyMusic, follow the steps on our help page. This data includes your User Data, Usage Data, and other data listed in Section 3: Personal Data We Collect About You.
• You can also contact us to request removal.
Restriction
Request that we stop processing some or all of your personal data.
You can do this if:
• your personal data is incorrect.
• our processing is unlawful.
• we do not need your information for a specific purpose.
• you object to our processing and we are evaluating your request to object. See the Object section below.

You can request that we stop processing temporarily or permanently.
You can exercise your right to restriction by contacting us.
Opposition
Object to our processing of your personal data.
You can do this if:
• MonkeyMusic processes your personal data under the legal basis of legitimate interests.
• MonkeyMusic processes your personal data to carry out direct advertising.
To exercise your right to object you can do the following:
• Use the controls on the MonkeyMusic Service to disable or adjust some of the features that process your personal data. For example, you can disable Personalized Advertising in your Privacy Settings.
• When MonkeyMusic does not provide a control, please contact us to object.
data portability
Request a copy of your personal data in electronic format and transmit that personal data for use in the service of another entity.
You can ask us to transmit your data when we process your personal data under the legal basis of consent or performance of the contract. However, MonkeyMusic will try to honor any request to the best of its ability.

Not be subject to automated decision making
Not be subject to a decision based solely on automated decision making (decisions that do not involve people), including crProfiling, in cases where the decision could affect you from a legal or similar point of view in a significant way.
MonkeyMusic does not perform this type of automated decision making on the MonkeyMusic Service.
Revocation of consent
Revoke your consent to the collection or use of your personal data.
You can do this if MonkeyMusic processes your personal data based on the legal basis of consent.
To revoke your consent, you can do the following:

Presentation of complaints
Please contact the Swedish Privacy Protection Authority or your local data protection authority if you have questions or concerns.

3. Personal data we collect about you
These tables set out the categories of personal data that we collect and use.

In some cases, we may use a third party application, such as Google Maps, to verify your address.

Your general location (not precise)
Your general location includes country, region, or state. We may obtain this information from technical data (eg, your IP address, language settings on your device) or currency of payment.
We need this information for the following:
• comply with the geographic requirements of our agreements with the owners of the content on the MonkeyMusic Service
• deliver content and ads that are relevant to you

Sensor data from your device
Data from mobile sensors generated by movement or orientation (eg, accelerometer or gyroscope) if needed to provide

functions of the MonkeyMusic Service that require this data.
Additional data you provide us

If voice features are available in your market and only if you have granted permission to use a voice feature, we will collect and process voice data. Voice feature data is audio recordings of your voice and transcripts of those recordings.

Payment and purchase data
If you make any purchases from MonkeyMusic or sign up for a trial, we will need to process your payment details. This includes the purchase of a paid Service Option.
The exact personal data collected and used varies depending on the payment method. It will include information such as the following:

• card type, expiration date and certain digits of the card number if you use a credit or debit cardImportant: for security reasons, we never store the full card number

Technical Services Partners
We work with technical service partners who provide us with certain data. This includes mapping IP addresses to inaccurate location data (eg, country/region, city, state).
This makes it possible for MonkeyMusic to provide the MonkeyMusic Service, content and features.
Payment partners and merchants
We may obtain data from our payment partners if you choose to pay through a third party (eg Telco operator).
This allows us:
• send you invoices
• process your payments
• give you what you bought

If we refer you to a merchant, we receive data from the merchant that is related to your purchase. For example, we may redirect you to an artist's merchandise store on a third party platform or to a third party ticketing website.
Receiving this information allows us to:
• calculate any commission due to us
• analyze the effectiveness of our partnership with these business partners
• understand your interests
Marketing and advertising partners
We receive inferences (ie, our understanding) of your interests and preferences from certain marketing and advertising partners.
This allows us to deliver more relevant ads and advertising.
If you download the MonkeyMusic mobile app and attempt to use MonkeyMusic through an offline user experience, we will collect limited information about your use of the MonkeyMusic Service, including usage data. We do this to understand how you access and use the Service. We also do this to make sure we provide you with the right experience, for example based on your country or region. If you choose to create a MonkeyMusic account to experience our full service, we will combine this data with your MonkeyMusic account data.

4. The purpose of using your personal data

5. How we share your personal data

The following personal data will always be publicly available on the MonkeyMusic Service:

• other content you post on the MonkeyMusic Service, including associated titles, descriptions and images
• who you follow on the MonkeyMusic Service
• who follows you on the MonkeyMusic Service (you can block followers)
You or another user may share certain information on third-party services, such as social networks or messaging platforms. This information includes the following:

• any content you post on MonkeyMusic and details about that content

When this exchange occurs, the third party service may store a copy of the exchanged data for the use of its features.
Personal data you can choose to share
We will only share the following personal data with the recipients described in this table:
• when the sharing of personal data is necessary for the use of a function of the MonkeyMusic Service or a third party application, service or device, which you have chosen to use
• if you give us permission to share your personal data; for example, you may do so by selecting the appropriate settings on the MonkeyMusic Service or by providing your consent.

For example, in the Social section of settings, you can choose to share your recently listened to artists and playlists on your profile. You can also choose to create or join a shared playlist with other users. Shared playlists give you social recommendations based on your recent activity.

What is personalized advertising?
• It is when we use information from third parties to personalize the ads and make them more relevant to you. It is also known as interest-based advertising.
• An example of a personalized ad is when an advertising partner has information that suggests you like cars. This gives us the opportunity to show you ads about cars.
How to control personalized advertising:
• You can control personalized advertising in the Privacy Settings of your account in the Personalized Ads section.
• You can also control personalized advertising for some podcasts by using the link in the show's episode description. This applies when the content provider finances your podcast by inserting personalized advertising or content-based advertising within the podcast itself. These controls are managed by the podcast's hosting provider, which may not be MonkeyMusic.
If you don't enable the personalized ads option in your Privacy Settings, you may still receive ads on services that support ads (eg, on podcasts or the free service option). This advertising is based on your registration information and the content you play on our services. For example, if you're listening to a cooking podcast, you might hear an ad for a food processor.

Our partners may also combine the personal data we share with them with other data they collect about you, e.g. e.g., your use of its services. We and our partners may use this information to present you with offers, promotions or other advertising activities that we think you will find relevant.

Hosting platforms host podcasts in order to offer them to you. We share certain data, such as your IP address, with hosting platforms when you play a podcast. MonkeyMusic owns two hosting platforms, Megaphone and Anchor. We also allow you to play podcasts that are available on hosting platforms other than MonkeyMusic.

Podcast providers must explain which platform hosts the podcast in the episode or show description. Check the privacy policy of each hosting platform to know how they use the data that is shared with them.

6. Data retention
We retain your personal data only for as long as necessary to provide you with the MonkeyMusic Service and for MonkeyMusic's legitimate and essential business purposes, for example:
• maintain the performance of the MonkeyMusic Service
• make data-driven business decisions about new features and offerings
• comply with our legal obligations
• resolve disputes
The criteria we use to determine how long we keep your data include the following:
• How can we minimize the data retention period? Our services are designed to delete personal data within 90 days, unless another timeframe is selected for legitimate business reasons.
• Is it necessary for us to keep the data to ensure that the service that users expect is provided? Personal data is kept for an appropriate period to provide our clients with a personalized service over time. In general, we retain viewing history for as long as the account is open, for example, to provide playlists of memories that users can enjoy (such as Memories of Summer and your year round campaign), as well as recommendations personalized based on what the user is currently listening to.
• Can users update or delete data on their own? In cases where users can view and update their personal data on their own, we keep that information for as long as the user wants. For example, we retain the email address registered with MonkeyMusic and other information in your profile until you decide to change or delete it.
• Do we need to keep the data to comply with our rules and keep our service secure? To ensure user safety, protect against harmful content on our platform, and take action against claims of intellectual property infringement, we retain data that has been removed from the MonkeyMusic Service for a limited period. This helps us investigate potential violations of our User Guidelines and Platform Rules.
• Does MonkeyMusic have a legal or contractual obligation to save or delete the data? Yes, for example, in cases of mandatory data retention laws, government orders to preserve data relevant to an investigation, or data being saved for legal proceedings. On the other hand, we remove any content that is not legitimate if we have a legal obligation to do so.

7. Transfer to other countries
Due to the global nature of our business, MonkeyMusic shares personal information internationally with MonkeyMusic group companies, subcontractors and partners, in order to provide the MonkeyMusic Service to you. These entities may process your data in countries whose data protection laws are not considered as strict as the laws of the EU or the laws that apply where you live. For example, they may not give you the same rights over your data.
When we transfer personal data internationally, we use tools to:
• ensure that the transfer of data complies with applicable law
• help provide your data with the same level of protection as it has in the EU
To ensure that each data transfer complies with applicable EU law, we use the following legal mechanisms:
• Standard Contractual Clauses (SCCs). These clauses require the other party to protect your data and provide you with rights and protections at the same level as those in the EU. For example, we use SCC to transfer the personal data described in Section 3: Personal Data We Collect About You to our hosting provider that uses servers in the United States. To exercise your rights under the standard contractual clauses, please contact us or the external entity that processes your personal data.
• Appropriateness decisions. This means that we transfer personal data to countries outside the European Economic Area that have adequate laws to protect your personal data, as determined by the European Commission. For example, we transfer the personal data described in Section 3: Personal Data We Collect About You to vendors in Canada, South Korea, Japan, the United Kingdom, and Switzerland.
We also identify and use additional protections as appropriate for each data transfer. For example, we use the following:
• technical protections, such as encryption and pseudonymization

8. How we keep your personal data secure
We are committed to protecting the personal data of the user

You can sign out of MonkeyMusic on multiple devices at once by using the Sign Out Everywhere feature on your account page.
If other people have access to your MonkeyMusic account (for example, if you have given them permission to use your account on a shared device), they will be able to access the personal data, controls and the MonkeyMusic Service available in your account.
It is your responsibility to give people permission to use your account if you don't mind sharing that personal information with them. Any other person's use of your MonkeyMusic account may affect your personalized recommendations and may be included in your data download.

We may occasionally make changes to this Policy.
When we make material changes to this Policy, we will provide you with prominent notice as appropriate under the circumstances. For example, we may display a prominent notice on the MonkeyMusic Service or send you a notification by email or on your device.

 

MonkeyMusic users may post, upload or otherwise contribute content to the MonkeyMusic Service ("User Content"). For the avoidance of doubt, the term "User Content" includes all information, materials and other content that users add, create, upload, submit, distribute or post to the MonkeyMusic Service (including the MonkeyMusic Support Community) .

You are solely responsible for the User Content you post.

You promise that, with respect to User Content that you post to MonkeyMusic, (1) you own or have the right to post such User Content; (2) such User Content, or MonkeyMusic's use of it pursuant to the license granted below, does not (i) violate the Terms, applicable laws, or the intellectual property or other rights of any third party, or (ii) such User Content User does not imply any authorization or affiliation of you or your User Content by MonkeyMusic or any artist, band, label or other individuals or entities without the prior written consent of MonkeyMusic or such individual or entity.

When posting or sharing User Content or other information on the MonkeyMusic Service, please be aware that the content and other information may be accessible to the public, used and re-shared by others on the MonkeyMusic Service and on the Web. For this reason, we ask you to be careful when posting or sharing on the MonkeyMusic Service, and to be aware of your account settings. MonkeyMusic is not responsible for what you or others post or share on the MonkeyMusic Service.

Monitoring of user content

MonkeyMusic may, but is not obligated to, monitor and review Authorized User Content. MonkeyMusic reserves the right to remove or disable access to any User Content for any or no reason. MonkeyMusic may perform these actions without prior notice.

Licenses you provide us

You retain ownership of your User Content when you post it to the Service. However, in order for your User Content to be available on the MonkeyMusic Service, we need a license to that User Content from you. Accordingly, you hereby grant to MonkeyMusic a worldwide, irrevocable, fully paid, royalty-free, sub-licensable, transferable, non-exclusive license to reproduce any User Content, make it available, present and display it, translate it, modify it, create derivative works thereof, distribute or otherwise use it in any medium, whether alone or in combination with other Content or material, in any way, by any method or technology, now known or hereafter created, in connection with the MonkeyMusic Service. Where applicable and permitted by applicable law, you also agree to waive and not enforce any "moral rights" or equivalent rights, such as the right to be identified as the author of any Authorized User Content, including Comments, and your right to object to derogatory treatment of such User Content.

Comments

If you provide ideas, suggestions or other feedback in connection with your use of the MonkeyMusic Service or any Content ("Feedback"), such Feedback is non-confidential and may be used by MonkeyMusic without restriction or payment. Comments are considered a type of User Content under these Terms.

You also grant us the right to (1) allow the MonkeyMusic Service to use the processor, bandwidth, and storage hardware on your Device to facilitate the operation of the MonkeyMusic Service, (2) provide you with advertisements and other information, and allow our partners commercials do the same, in accordance with MonkeyMusic's Privacy Policy.

content experience
The Content you access on any part of the MonkeyMusic Service, including selection and positioning, may be influenced by business considerations, including MonkeyMusic's agreements with third parties.

Some Content that MonkeyMusic licenses or provides, creates or makes available (for example, podcasts) may contain advertisements for which MonkeyMusic is not responsible.
